Gorilla Arm Ltd (we or us) is committed to protecting and respecting your privacy. Please read this policy carefully to understand our practices regarding your personal data and how we treat it. This policy:

Applies to your use of the Rtist application software, an online platform that connects artists with end-users who want to commission artwork (the App), once you have downloaded or streamed a copy of the App onto your device.

Also applies to your use of any of the services, provided by us, that are accessible through the App.

Sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.

For the purposes of the Data Protection Act 1998, the data controller is Gorilla Arm Ltd (Company Number: 09125399), whose registered office is at 145-157 St John Street, London EC1V 4PW.


We may collect, process and use the following information about you for various different purposes:

1.1 Information that you give us: you may give us information about you by filling in forms on the App, or corresponding with us (for example, by e-mail), and this includes information you provide to us when you download or use the App (or any part of or function within the App). The information you give us may include (without limitation) your name, address, e-mail address, phone number, age, username, password and other registration, financial and credit card information. If you contact us, we may also keep a record of our resulting correspondence with you.

1.2 Information we collect about you and your device: each time you use the App, we may automatically collect:

(a) technical information including, for example, the type of mobile device you use, a unique device identifier (such as your device’s IMEI number, or the MAC address of your device’s wireless network interface), mobile network information, your mobile operating system, or the type of mobile browser that you use;

(b) information stored on your mobile device, including contact information, friends lists, login information, photos, videos and other digital content (and we may also use GPS technology to determine your location); and

(c) details about your use of the App and the services, resources or content that you access through the App.

1.3 Information we receive from other sources: we may work with third parties (including, for example, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers and credit reference agencies) and we may receive information about you from them.

We may also associate any such category of information with any other such category of information – if that is the case, we will treat the combined information as personal data in accordance with this policy (for as long as it is combined).


2.1 A cookie is a small file of letters and numbers that (if you agree) we may store on your browser or the hard drive of your device. Cookies contain information that is then transferred to your device. We use cookies to distinguish you from other users of the App. This helps us to provide you with a good experience, when you use the App, and also allows us to improve the App. By continuing to use the App, you are automatically agreeing to our use of cookies.

2.2 We use the following cookies: (a) essential cookies: these are required to operate the App and, for example, enable you to log into secure areas of the App and use other services available through the App (b) analytical/performance cookies: these allow us to see when and how you use the App, and help us to improve the way it works (c) functionality cookies: these are used to recognise you when you use the App, and enable us to personalise our content for you, greet you by name and remember your preferences and (d) targeting cookies: these record your use of the App, which parts of the App you visit and any links that you follow. We use this information to make the App more relevant to your interests (and we may share this information with third parties for that purpose).

2.3 Third parties (including, for example, advertising networks and providers of external services) may also use cookies, over which we have no control. These cookies are likely to be analytical/performance cookies or targeting cookies. You can block cookies but, if you do so, you may not be able to access or use all parts of the App. Except for essential cookies, all cookies will expire after a certain period.


3.1 We may disclose to advertisers some or all of the data that we collect from you, when you download or use the App. We do not disclose information about identifiable individuals, but we may provide them with anonymous aggregate information about our users. We may also use such aggregate information to help advertisers reach the kind of audience they want to target. We may make use of the personal data collected from you to comply with our advertisers' wishes by displaying their advertisements to a targeted audience.

3.2 We may disclose your personal information to any member of our corporate group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in Section 1159 of the Companies Act 2006.

3.3 We may disclose your personal information to third parties (a) if we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer (b) if Gorilla Arm Ltd or substantially all of its assets are acquired by a third party, in which case personal data held by us about the users of the App will be one of the transferred assets (c) if we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request (d) in order to enforce or apply any of the terms or conditions on (and subject to) which you use the App, or to investigate any potential breach of those terms and conditions or (e) where necessary, to protect the rights, property or safety of Gorilla Arm Ltd, the users of our App or others, including (without limitation) exchanging information with other companies and organisations for the purpose of fraud protection or credit risk reduction.

3.4 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of that data, so any transmission of that data by you is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access. Please ensure that, when using any social media features on the App, you do not submit any personal data that you do not want to be seen, collected or used by other users of the App.


4.1 The data we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. These staff may be engaged in the processing of your payment details and the provision of other support services. By submitting your personal data to us, you agree to this transfer, storage or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

4.2 All information you provide to us is stored on our secure servers. Any payment transactions carried out by us, or our chosen third-party provider of payment processing services, will be encrypted. Where we have given you (or where you have chosen) a password that enables you to access certain parts of the App, you are responsible for keeping that password confidential. We ask you not to share any such password with anyone else.

4.3 We may also collect and store personal data on your device using application data caches, browser web storage or other technology.


5.1 You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before we collect your data) if we intend to use your data for such purposes, or if we intend to disclose your information to any third party for such purposes. 5.2 The App may contain links to and from websites of our partners, advertisers and affiliates (including, but not limited to, websites on which the App is advertised). If you follow a link to any of these third party websites, please note that these websites (and any services that may be accessible through them) should have their own privacy policies. We do not accept any responsibility or liability in connection with those policies or for any personal data that may be collected through such third party websites or the provision of any related services. Please check the relevant policies on any such third party website before you submit any personal data to that website (or use any of the services accessible through it).

5.3 The Data Protection Act 1998 gives you the right to access information held about you, which can be exercised in accordance with that Act. Any access request may be subject to payment of a fee of £10.00 to meet our costs in providing you with details of the information that we hold about you.

We may change this privacy policy, at any time, by posting the amended version here. We may also notify you of the changes by SMS, e-mail or when you next use the App. The amended policy may also be displayed on the screen of your device, and you may be required to read and accept it in order to continue using the App. In any event, the amended policy will be effective fourteen (14) days after it is initially posted here. Your use of the App after that date will constitute your acceptance of the amended policy.
